Terms and Conditions
1. Eligibility:
You must be at least 18 years old to use the Zaburb Services.
If you are registering on behalf of a senior citizen, you acknowledge you have their consent (written or documented) and are authorized to act on their behalf.
2. User Accounts:
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.
You agree to notify Zaburb immediately of any unauthorized use of your account or any other security breaches.
3. Services:
Zaburb connects you with security guards employed by PSARA licensed security agencies ("Providers").
Zaburb verifies the licenses and background checks of Providers before allowing them on the platform.
Zaburb does not employ the Providers and is not responsible for their actions or services beyond the platform functionality.
Zaburb reserves the right to deactivate any Provider account at any time, including but not limited to, based on user feedback or performance issues.
4. Service Requests and Cancellations:
You can request security services through the Zaburb app.
Zaburb will display estimated arrival times for Providers based on availability.
You may cancel a service request before a Provider is dispatched without penalty.
Cancellations after a Provider is dispatched may be subject to a cancellation fee as displayed on the app.
You agree to pay all fees associated with the Services as displayed on the app.
Zaburb accepts various payment methods compliant with Indian regulations.
You are responsible for any applicable taxes associated with your use of the Services.
6. Disclaimers and Limitations of Liability:
Zaburb makes no guarantees regarding the availability or response time of Providers.
While Zaburb verifies Providers, you acknowledge that using the Services involves inherent risks and agree to hold Zaburb harmless for any damages arising from your use of the Services, except for intentional misconduct or gross negligence by Zaburb.
Zaburb's liability is limited to the maximum extent permitted by Indian law.
7. User Content:
You are responsible for any content you share through the Zaburb app ("User Content").
User Content must not be illegal, infringing, or offensive.
Zaburb reserves the right to remove User Content that violates these Terms or applicable Indian law.
8. Data Privacy:
Zaburb is committed to protecting your privacy. Please refer to our separate Privacy Policy for details on how we collect, use, and protect your data, including: * Health information: We collect health information with your explicit consent to better understand your needs and ensure Providers are equipped to assist you. * Location data: We use location data to dispatch Providers efficiently. You can control location sharing through your device settings. * Phone number: We use your phone number to contact you for locating and verification purposes (OTP generation).
9. Term and Termination:
These Terms are effective upon your use of the Zaburb app.
Zaburb may terminate your account at any time for any reason, with notice. Reasons may include violation of these Terms, non-payment, or inactive accounts.
You may terminate your account at any time by deactivating your account through the app.
10. Intellectual Property:
Zaburb owns all intellectual property rights associated with the app and Services.
You are granted a non-exclusive, revocable license to use the app and Services in accordance with these Terms.
11. Modifications to the Terms:
Zaburb reserves the right to modify these Terms at any time.
Continued use of the app following any modification constitutes your acceptance of the revised Terms.
12. Governing Law and Dispute Resolution:
These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
13. Entire Agreement:
These Terms constitute the entire agreement between you and Zaburb regarding your use of the Services.
14. Severability:
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
